1. Mr. Ghosh, Learned Advocate appearing for the CESC authority files an additional report prepared by the District Engineer, North Suburban District, which is stated to be signed by the petitioner as well as the respondent no.4 on September 5 , 2026.
2. Parties before this Court agree that electricity connection can be granted to the petitioner in terms of additional report filed in Court today.
3. The Additional Report in paragraph 2 thereof provides that:
“…….both the petitioner and the objector/private respondent have confirmed the above passage to be a common passage through which the proposed underground cable can be laid. A photograph of the said common passage is annexed herein and marked as Annexure “B” ”.
4. In view of the aforesaid since the dispute as regards laying of underground cable has been resolved between the parties in terms of the additional report
2 filed in court today, nothing further remains to be order on this writ petition as regards the same.
5. CESC Limited shall now proceed to effect electricity supply in favour of the petitioner in terms of the additional report, subject to compliance of all formalities by the petitioner.
6. Since, the private respondent has accepted the additional report, no objection should be raised by the private respondent against the CESC Ltd. executing the job of effecting electricity supply in terms of additional report. However, if any objection is raised, the CESC authorities would be entitled to approach the respondent no.3 i.e. Officer-in-Charge, Noapara Police Station seeking police assistance. If the said Officer-in- Charge is approached, the said Officer-in-Charge would afford adequate police assistance to the respondent CESC authorities in terms of this order.
7. Costs for such Police assistance would be borne by the petitioner.
8. The CESC authorities would complete the exercise of effecting the electricity supply in favour of the petitioner within four weeks from the date of compliance of all formalities including payment of requisite charged in accordance with law, by the petitioner.
