Heard the parties.
The petitioners have been made accused in connection with Gumla P.S. Case No.70 of 2018 corresponding to G.R. Case No.278 of 2018 registered for the offences punishable under Sections 467, 468, 471, 420, 120B of the Indian Penal Code.
This is the second journey of the petitioners with the prayer for regular bail, earlier the prayer for regular bail of the petitioners was dismissed as withdrawn vide order dated 02.07.2025 in B.A. No.5330 of
2025. Learned senior counsel for the petitioners submits that the petitioners have filed a supplementary affidavit furnishing the undertaking that they are ready and willing to undertake that they will
follow the conditions imposed for granting them anticipatory bail and that they will not go over or enter into any of lands of Mauza-Bargao except those under plot no.659 of area 0.89 decimals, plot no.685 of area 0.50 decimals, plot no.744 of area 1.01 decimals, plot no.686 of area 0.11 decimals, plot no.392 of area 0.26 decimals of Khata No.32 and the petitioners will also not to go over or enter into any of the land of Mauza- Muhhgao except those under plot no.200 of area 0.57 decimals of Khata no.1 until and unless an order in their favour is passed by a competent court of law. It is next submitted that the allegation against the petitioners is false. It is then submitted that the alleged offences are triable by the Court of Magistrate. It is next submitted that the petitioners undertake that they will co-operate with the trial of the case and additionally will not annoy or disturb the informant or their family members during the trial of the case. It is lastly submitted that the petitioners have been in custody since 27.03.2025 as is evident from para- 20 of this bail application. Hence it is submitted that the petitioners be released on bail.
Learned Addl.P.P. opposes the prayer for bail.
Considering the facts of this case, the above-named petitioners are
directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Gumla in connection with Gumla P.S. Case No.70 of 2018 corresponding to G.R. Case No.278 of 2018 with the condition that they will not go over or enter into any of lands of Mauza-Bargao except those under plot no.659 of area 0.89 decimals, plot no.685 of area 0.50 decimals, plot no.744 of area 1.01 decimals, plot no.686 of area 0.11 decimals, plot no.392 of area 0.26 decimals of Khata No.32 and the petitioners will also not to go over or enter into any of the land of Mauza-Muhhgao except those under plot no.200 of area 0.57 decimals of Khata no.1 until and unless an order in their favour is passed by a competent court of law and will co-operate with the trial of the case and furnish their mobile numbers and photocopy of the Aadhar Cards in the court below with an undertaking that they will not change
their mobile numbers and will not annoy or disturb the informant and their family members during the trial of the case.
