Accused No.1 in Crime No.86 of 2026 registered by Chamarajanagar East Police Station, Chamarajanagara District for offences punishable under Sections 318(4), 319(2), 329(3), 336(2), 336(3), 340(2) of BNS, 2023 is before this Court in this petition filed under Section 482 of BNSS, 2023 seeking anticipatory bail. 2. Heard the learned counsel for the parties. - 3 - HC-KAR CNR: KAHC010583902026 NC: 2026:KHC:50834 CRL.P No. 13076 of 2026 3. One Manjugowda claiming to be the general power of attorney holder of S S Patil alias Shashishekara S Patil had approached Yelahanka New Town Police Station, Bengaluru and based on his first information, a zero FIR was registered for the aforesaid offences and subsequently the same was transferred to Chamrajanagar East Police Station, and numbered in Crime No.86 of 2026. Apprehending arrest in the case, the petitioner had filed Crl.Misc.No.308 of 2026 before the jurisdictional Sessions Court which was rejected on 05.08.2026. Therefore, he is before this Court. 4. Perusal of the material on record would go to show that, first informant Manjugowda K V, claiming to be general power of attorney of S S Patil had approached the police and contended that the petitioner had created fraudulent documents in respect of properties belonging to S S Patil bearing Survey No.3 (old Survey No.3/58A) measuring 5 acre 16 guntas situated at Chandakavadi Hobli, Chamarajanagara District. He has alleged that in the year 2011 and 2012, the petitioner has trespassed into the aforesaid property and there was already a complaint filed in that regard. He has also stated - 4 - HC-KAR CNR: KAHC010583902026 NC: 2026:KHC:50834 CRL.P No. 13076 of 2026 that there is a civil suit pending in O.S.No.40 of 2026 in respect of the very same property. 5. Learned counsel for the petitioner has produced copy of the plaint in O.S.No.40 of 2026, which is pending before the jurisdictional civil court at Chamarajanagar. The first informant Manjugowda is the plaintiff in the said suit. S. S. Patil and his wife Nirmala S Patil are the defendant nos.1 and 2 in the said suit. One Ramesh D S and Vishwanath Karvi, are arrayed as defendant nos.3 and 4 in the said suit. The prayer column of the plaint in O.S.No.40 of 2026 would go to show that Manjugowda has prayed for a declaration in the said suit to declare him as the absolute owner of the suit schedule property and also grant consequential relief of permanent injunction and update the revenue records in his favour. The said suit is filed on 09.02.2026, whereas the complaint is filed subsequently in month of June, 2026 wherein Manjugowda, who has claimed reliefs against S S Patil in O.S.No.40 of 2026, claims to be his power of attorney. - 5 - HC-KAR CNR: KAHC010583902026 NC: 2026:KHC:50834 CRL.P No. 13076 of 2026 6. The dispute between the parties appears to be purely civil in nature. The petitioner, who has no other criminal antecedents has undertaken to cooperate with the police for the purpose of investigation. The alleged offences are all triable by the Court of Magistrate and maximum punishment for the alleged offences is imprisonment for a period of seven years. Under the circumstances, Accordingly, the following: ORDER (i) The Criminal Petition is allowed. (ii) The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.86 of 2026 registered by Chamarajanagar East Police Station, Chamarajanagara District for offences punishable under Sections 318(4), 319(2), 329(3), 336(2), 336(3), 340(2) of BNS, 2023, subject to the following conditions:- 1. The petitioner shall appear before the Investigating Officer in the present case within a period of fifteen days from the date of receipt of certified copy of this order on executing a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh - 6 - HC-KAR CNR: KAHC010583902026 NC: 2026:KHC:50834 CRL.P No. 13076 of 2026 only) with two sureties for the likesum to the satisfaction of the investigating officer/jurisdictional Court. 2. The petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. The petitioner shall not tamper with the prosecution witness and he shall co-operate with the Police for investigation and appear before them whenever called upon. 4.
