JUSTICE V SRISHANANDA ORAL ORDER 1. Heard Sri.P.P.Hegde, learned Senior Counsel for Sri.Yathin B., learned counsel for the petitioner. This Court did not deem it fit to issue notice to the respondents as the matter can be disposed of by suitable observations. 2. Petition is filed under Articles 226 and 227 of the Constitution of Indian read with Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 with the following prayer: “In view of the above facts and circumstances, the petitioner respectfully prays that this Hon’ble Court may be pleased to: a. Issue a writ of mandamus or any other appropriate directions/orders, directing the Court of Addl. District and Sessions Judge Udupi sitting - 3 - HC-KAR CNR: KAHC010541382026 NC: 2026:KHC:49286 WP No. 24770 of 2026 at Kundapura to decide and dispose of Crl.RP.No.506/2022 vide Annexure-E, expeditiously and within the time that may be fixed by the Hon’ble Court; and b. Issue appropriate directions to the said Court to decide the IA No.1 vide Annexure-D, filed for stay within a timeframe fixed by this Hon’ble Court. c. Grant such other and further reliefs as the Hon’ble Court deems fit to grant under the circumstances of the suit, in the interest of justice and equity.” 3. Crl.RP.No.506/2022 is pending on the file of I Additional District and Sessions Jugde, Udupi Sitting at Kundapura. For considerable amount of time, the matter could not be disposed of for one reason or the other by the learned Judge hither to. 4. It is now submitted that Court is presided over by a new Judge and if a direction is issued to dispose of the revision petition in a time bound manner, petitioner is satisfied. 5. It is emphasized that all criminal matters are required to be disposed of as early as possible is the general - 4 - HC-KAR CNR: KAHC010541382026 NC: 2026:KHC:49286 WP No. 24770 of 2026 rule. However, since the present revision petition is arising out of an order passed granting the maintenance in Crl.M.C.No.98/2018 dated 29.12.2021 on the file of II Additional Civil Judge and Judicial Magistrate First Class, Kundapura, and the revision petition itself is of the year 2022, it is just and necessary to dispose of the present petition by directing the I Additional District and Sessions Judge, Udupi Sitting at Kundapura to dispose of in a time bound manner. 6. Accordingly, following: ORDER i. Petition stands disposed of. ii. Crl.RP.No.506/2022 on the file of I Additional District and Sessions Judge, Udupi Sitting at Kundapura shall be disposed of on or before 31.12.2026.
