The petitioners are apprehending their arrest in connection with Hazaribag Sadar P.S. Case No.297 of 2025 for the alleged offences registered under Sections 115(2), 117(2), 126(2), 109(1), 351(2), 351(3), 352, 74 and 3(5) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned C.J.M., Hazaribag. 3. Learned counsel appearing for the petitioners submits that roof casting was made on house and curing was being made and pursuant to that water has gone to the neighbour’s roof and for that altercation took place. He further submits that false allegations are made of molestation and the injury is said to be simple. He then submits that the petitioner No.1 is a commerce graduate (B.B.A.) 2026:JHHC:8327 --2-- A.B.A. No. 1108 of 2026 and was working outside of Hazaribag and petitioner No.2 is a Computer Engineer and working in call centre at Bangalore. He next submits that the petitioners have got no criminal antecedent as disclosed in paragraph No.11 of the petition. He also submits that on the date of alleged occurrence the petitioners were not present in the city. 4. Learned counsel appearing for the State opposed the prayer and submits that allegations of assault and molestations are there. 5. In paragraph No.10 of the petition, it has been disclosed that the petitioners are working outside the city and it has been argued that the petitioners were not present in the city on the alleged date of occurrence and the petitioners have got no criminal antecedent as disclosed in paragraph No.11 of the petition and in that view of the matter the petitioners are directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioners on such terms and conditions or the sureties as the learned Court may deem fit and proper.
