Tr.Crl.P.No.122 of 2025 Order:
This petition is filed by the informant/defacto complainant in Crime No.99 of 2025 at the Airport Law & Order Police Station, Visakhapatnam, vide C.C.No.2808 of 2025, on the file of learned VII Additional Judicial Magistrate of First Class at Visakhapatnam with a prayer to transfer the case to any Judicial Magistrate of First Class Court at Tirupati. 2. The learned counsel for the petitioner contends that the petitioner is residing at Tirupati and as there are matrimonial disputes with her husband, she had shifted from Visakhapatnam to Tirupati. The petitioner contends that if she has to attend the Court at Visakhapatnam, she has some threats. Therefore, to protect her interest, the transfer of the case is necessary. 3. It is evident from the charge-sheet enclosed the prosecution witnesses are seven (7) in number and the petitioner herein is arrayed as L.W.-1 and her address is shown at Visakhapatnam, though it is stated that now she is now residing at Tirupati. The other prosecution witnesses, both official and private, are shown as residents of Visakhapatnam.
The prayer is found not convincing for transfer of C.C.No.2808 of 2025 from the file of learned VII Additional Judicial Magistrate of First Class at Visakhapatnam to any Judicial Magistrate of First Class at Tirupati in the context stated above and upon application of test of forum convenience. However, to address the

apprehension of the petitioner that there are some threats, she is at liberty to make an application before the concerned Court for necessary direction and relies on the ground of her vulnerability. 4. In view of the aforesaid reasons, this Transfer Criminal Petition is liable to be dismissed and hence, dismissed. There shall be no order as to costs.
