Accused no.1 in Crime No.3/2026 registered by Gangammana Gudi Police Station, Bengaluru City for the offences punishable under Sections 406, 420, 419, 465, 471, 506(1)(2), 149 of IPC, is before this Court in this petition filed under Section 482 of BNSS 2023 seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.3/2026 was registered by Gangammana Gudi Police Station, Bengaluru City for the aforesaid offences against the petitioner and others, based - 3 - HC-KAR CNR: KAHC010490462026 NC: 2026:KHC:49381 CRL.P No. 10619 of 2026 on the first information dated 06.01.2026 received from Sri Chandrashekar C.M., who is the alleged victim in the present case. Apprehending arrest in the case, the petitioner had filed Crl.Misc.No.5543/2026 before the jurisdictional Sessions Court, which was rejected on 24.06.2026. Therefore, he is before this Court. 4. A reading of the first information would reveal that, for the period from 09.12.2022 to 25.04.2024, the petitioner and other accused persons named in the FIR had represented to the first informant and similarly situated other persons that they would secure appointment to the posts of First Division Assistant, Second Division Assistant, etc., in the High Court and other Courts, and had collected huge amount of money and thereafter cheated them. 5. The records made available to the Court by the learned Counsel for the petitioner would reveal that prior to the registration of the present case, multiple criminal - 4 - HC-KAR CNR: KAHC010490462026 NC: 2026:KHC:49381 CRL.P No. 10619 of 2026 cases of similar nature were registered against the petitioner and other accused persons in the present case based on the first information received from similarly situated victims. In Crime No.13/2025 registered by Jalahalli Police Station, Bengaluru City, and in Crime No.61/2025 registered by Byatarayanapura Police Station, Bengaluru City, petitioner who was arrested was subsequently enlarged on bail. It appears that altogether six cases of similar nature have been registered against the petitioner and other accused persons in the present case with similar allegations. When the petitioner was arrested in Crime No.13/2025 and Crime No.61/2025 as aforesaid, he was already interrogated in the said cases, and thereafter, enlarged on bail. 6. In the present case, accused Nos.3 and 4 have been granted anticipatory bail by the jurisdictional Sessions Court in Crl.Misc.No.4027/2026 vide order dated 15.05.2026. The allegation against the petitioner and - 5 - HC-KAR CNR: KAHC010490462026 NC: 2026:KHC:49381 CRL.P No. 10619 of 2026 accused Nos.3 and 4, who have been granted anticipatory bail, is similar. 7. The petitioner, aged 69 years, has undertaken to cooperate with the police for the purpose of investigation. Since he was already interrogated along with the other two accused persons, while he was in custody in other criminal cases registered with similar allegations by various other police stations, I am of the opinion that the prayer made by the petitioner for grant of anticipatory bail needs to be answered affirmatively subject to appropriate conditions. Accordingly, the following order: 8. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.3/2026 registered by Gangammana Gudi Police Station, Bengaluru City for the offences punishable under Sections 406, 420, 419, 465, 471, 506(1)(2), 149 of IPC, subject to the following conditions: - 6 - HC-KAR CNR: KAHC010490462026 NC: 2026:KHC:49381 CRL.P No. 10619 of 2026 a) The petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. b) The petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. c) The petitioner shall not tamper with the prosecution witness and he shall co-operate with the police for investigation and appear before them whenever called upon. d) Petitioner shall not involve in similar offences in future.
