RANJITH KUMAR ...RESPONDENT(S): 2 Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or direction more particularly one in the nature of writ of Mandamus to declare the action of the respondent No.3 in not mentioning the Horizontal machinery with 20 HP motor capacity in the License No.29/2018 valid upto 31-12-2024 even inspite of the 5th respondent was permitted to run the vertical machinery and horizontal machinery and the ownership of the 5th respondent itself is changed in the name of the writ petitioner and consequently issuing Impugned Proceedings in Rc.No.3185/2022/H6, dt.01-10-2024 in intimating that the additional machinery i.e. Horizontal 20 HP motor capacity could not be sanctioned in favour of the petitioner as arbitrary, illegal, contrary to the decision of the 2nd respondent in its 18th meeting held on 19-02-2024 and violation of Articles 14, 19 and 21 of the Constitution of India and consequently set aside the Impugned Proceedings in Rc.No.3185/2022/H6, dt.01-10-2024 issued by the 3rd respondent and further direct the respondent No.3 to include the Horizontal machinery with 20HP motor capacity in the License No.29/2018, dt. 10-06-2024 granted to the petitioner permitting the writ petitioner to run both machinery of vertical and horizontal in the interest of justice. Heard Sri P.Nagendra Reddy, learned counsel for the petitioner and Ms.Baliboina Sravani, learned Assistant Government Pleader for Forests for the respondents. 3. Learned Assistant Government Pleader for Forests would submit that during the pendency of the present petition, the respondent-authorities have given the permission to use Horizontal machinery under the License No.29/2018 to the petitioner in this matter and they are utilizing the same and no further orders are required in this petition. 4. Learned counsel for the petitioner would submit that recording the same, the petition may be disposed of, setting aside the impugned Proceedings vide Rc.No.3185/2022/H6, dated 01.10.2024. 5. In light of the above submissions, the Writ Petition is disposed of, setting aside the impugned proceedings vide Rc.No.3185/2022/H6, dated 01.10.2024.
