Nur Nobi … Petitioner(s) Mr. Fazlur Rahman Mr. R. Rahman Ms. Dona Sanyal … for the Petitioner(s) Mr. Ajay Ray Mr. Supreem Naskar … for the State-respondent(s) Ms. R. V. Kundalia … defacto-complainant Learned advocate for the petitioner submits that the petitioner is in custody for two years and six months and till date out of the 21 witnesses, only five witnesses have been examined in the last few months. The records of the case and the medico-legal examination report depict that there were injuries sustained at the private parts of the victim who at the relevant point of time was about eight-year-old. Having regard to the evidence which has already surfaced; the gravity of the offence and the consequences of the severity of the punishment in case of conviction, I am not inclined to grant bail to the present petitioner. 2 Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM (M) 1817 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
