It appears from the report that the dwelling unit in question was sanctioned and constructed under ‘Banglar Awas Yojana’, Khokan Ruidas being the beneficiary. Therefore, the construction raised by the private respondents cannot be termed as unauthorised/illegal. The writ petition being devoid of merit, is dismissed. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
