Mr. Sanjoy Bose Mr. Priyankar Basu Mallick ..for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff/opposite party in Misc. Case 188 of 2022 praying for a direction upon the learned Civil Judge (Senior Division), 3rd Court at Alipore to dispose of Misc. Case 188 of 2022 expeditiously. The learned advocate appearing for the petitioner submits that the opposite party filed an application under Section 5 read with Section 8 of the Arbitration and Conciliation Act, 1996. He further submits that such application stood rejected on 21st September, 2022. He submits that thereafter the opposite party preferred an application for review under the provisions of Order 47 of the Code of Civil Procedure which was registered as Misc. Case No. 188 of 2022. He submits that the miscellaneous case is pending from the year 2022 and the same should be directed to be disposed of expeditiously. In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite parties. However, the learned advocate appearing 2 for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or upon the learned advocates representing them before the learned trial judge. In the light of the submissions made by the learned advocate for the petitioner, C.O. 3171 of 2026 stands disposed of by requesting the learned Civil Judge (Senior Division), 3rd Court at Alipore to take up the hearing of Misc. Case No. 188 of 2022 on the next date fixed, if the same is otherwise ready for hearing, and make an endeavour to dispose of the same as expeditiously as possible but preferably within a period three months from the next date fixed without granting any unnecessary adjournments to either of the parties. There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
