Mr. Mrinal Kanti Ghosh Mr. Chandranath Sarkar Ms. Bipasha Bhattacharya …for the petitioners Mr. Sovan Mukherjee Mr. Subhendu Bandopadhyay …..for the State respondents 1) Affidavit of service filed on behalf of petitioners is taken on record. 2) By presenting this writ petition, petitioners have prayed for implementation of ad interim order of injunction dated 11th November, 2025 passed on Title Suit No. 1088 of 2025 instituted by petitioners before the learned Civil Judge (Senior Division), Basirhat, North 24 Parganas. By said order dated 11th November, 2025 civil court directed principal defendants not to change nature and character of suit property. It is contended that for implementation of said ad interim order of injunction dated 11th November, 2025 civil court was approached and an order was passed on 17th January, 2026 directing concerned police authorities to take steps. 2 3) Learned advocate representing State respondents has filed a communication dated 6th September, 2026 of Officer-in-Charge, Minakhan Police Station, North 24 Parganas and same is taken on record. Copy of said communication is made over to learned advocate representing petitioners. 4) It is disclosed in communication dated 6th September, 2026 that private respondents being defendants in suit filed a petition before the civil court and hearing of that petition has been fixed on 20th November, 2026. 5) Since civil court is considering prayer of the parties to the suit in the context of ad interim order of injunction dated 11th November, 2025, at this stage this Court is not inclined to interfere with this writ petition. 6) Writ petition stands dismissed. 7) However, this order shall not preclude petitioners to approach civil court in pursuit of remedy. 8) Parties to act on server copy of this order duly downloaded from the official website of this Court.
