This writ petition has been filed under Article 227 of the Constitution of India, whereby petitioners have sought a direction to be issued to learned Civil Judge (S.D.), Roorkee, Haridwar to decide the temporary injunction application no.6C2 of the petitioners in Original Suit No.34 of 2024, Smt. Ramesho & another vs. Balwant Singh & others, pending before the learned trial court within a stipulated time fixed by this Court and further for a direction not to create any third party interest till disposal of the temporary injunction application no.6C2.
3. It is contended by learned counsel for the petitioners that on 17.01.2024 an Original Suit No.34 of 2024, Smt. Ramesho & another vs. Balwant Singh & others, was instituted by the petitioners in the court of learned Civil Judge (S.D.), Roorkee, Haridwar, wherein an application Paper No.6C2 under Order 39 Rules 1 and 2 r/w 151 of C.P.C. supported by an affidavit has also been filed for temporary injunction.
4. Learned trial court issued notice/summons to the respondents-defendants on the said application calling upon them to file their objection on the temporary injunction application by the date fixed on 01.02.2024 for disposal of the said application Paper No.6C2.
5. From perusal of the record, it transpires that till date no objections have been filed by the respondents- defendants on the temporary injunction application No.6C2, therefore in the back drop of the aforesaid
factrs and reasons, this Court cannot direct the learned Civil Judge (S.D.), Roorkee, Haridwar, for disposal of the aforesaid application.
6. Accordingly writ petition is dismissed at this stage.
