CORAM:JUSTICE G. SATAPATHY
Order No.
ORDER(ORAL) 23.04.2026
01. 1. This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Talcher PS Case No.1164 of 2025 corresponding to GR Case No.2085 of 2025 pending in the file of learned SDJM, Talcher, for commission of offence punishable U/S.309(6) of BNS, on the main allegation of snatching away the gold chain of the informant. 2. Heard, Mr. Ronit Ghosh, learned counsel for the petitioner and Mr. R.B. Mishra, learned Additional Public Prosecutor in the matter and perused the record. 3. Admittedly, the FIR has been lodged against unknown persons, but no TI parade has been conducted to identify the suspect/petitioner in this case. No doubt, the petitioner is having some criminal antecedent, but bail cannot be refused to the petitioner merely because he is having some criminal antecedents, unless there is prima facie material to implicate him. In this case, the implication of the petitioner as confirmed by learned State counsel is on the basis of statement of co-accused as well as his confession before police. In such view of p. 2 the matter and taking into account the pre-trial detention of the petitioner in custody since 19.11.2025 with submission of charge sheet in the meantime and grant of bail to co-accused Rajesh @ Susil Naik @ Sushil Naik in BLAPL No. 13900 of 2025, this Court without expressing any opinion on merits of the case, admits the petitioner to bail. 4. Hence, the bail application of the petitioner stands allowed and the petitioner is allowed to go on bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) only with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it with following condition:- (i) the petitioner shall report attendance before the jurisdictional Police Station once in a fortnight preferably on a Sunday in each month in between 10 A.M. to 12 Noon for six(06) months from the actual date of release from the custody. The I.I.C. of Jurisdictional Police Station shall not detain the petitioner unnecessarily after recording his attendance beyond the time as stipulated. 5. Accordingly, the BLAPL stands disposed of. Issue urgent certified copy of the order as per Rules.
A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference. (G. Satapathy)
