Learned advocate for the petitioner submits that the petitioner is a lady who has been implicated because she is the wife of an individual whom the Investigating Authority requires for the sake of their investigation. It is contended on behalf of the petitioner that there has been recovery of 132 kgs of ganja, however, the petitioner has no complicity except to the extent that some witnesses have stated that she used to help her husband in the business. 2. Learned advocate for the State opposes the prayer for bail and relied upon the statement of the witnesses. 3. I have taken into account the materials appearing and the memo of evidence. The petitioner is in custody for more than 75 days. 2 There are no antecedents of the petitioner as is reflected from the memo of evidence submitted before this Court. 4. Having considered the nature of materials which have surfaced and the period of detention and the petitioner being a lady and as there has been no recovery from the petitioner, I am inclined to release the petitioner on bail. 5. As such, the prayer for bail of the petitioner, namely, Suchandra Sarkar is allowed. 6. Accordingly, the petitioner shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court (NDPS Act), Nadia at Krishnanagar. 7. If on bail, the petitioner shall be physically present before the learned Trial Court on each and every date. Petitioner shall not leave the district of Nadia without prior permission of the learned Trial Court. 8. In the event, the petitioner fails to comply with any of the conditions as stated above, the learned Trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court. 9. Accordingly, CRM (NDPS) 1959 of 2026 is disposed of. 10. Memo of evidence submitted be kept with the record. 3 11. All parties shall act in terms of the server copy of the order downloaded from the official website of this Court. 12.
