ORDER The present Writ Petition has been filed seeking the issuance of a Writ of a Mandamus directing the first respondent to consider the representation of the https://www.mhc.tn.gov.in/judis
WP No. 23054 of 2026 __________ Page2 of 4 petitioner dated 25.04.1981 in the light of G.O.Ms.No.431, P&AR (Per.M), Department.
2. The case of the petitioner is that she was appointed as a Senior Inspector in the respondent Department in the year 2020 and subsequently, in the year 2024, she was promoted as Co-operative Sub-Registrar and posted to the office of the Joint Registrar of Co-operative Societies, Udhagamandalam Region, where she is presently serving as Assistant Director of Milk Audit at Ooty Circle. Due to her history of heart surgery, respiratory ailments caused by the cold climate of Nilgiris, her father’s serious health condition and her children’s education at Coimbatore, she sought a transfer to Coimbatore. Relying upon G.O.(Ms).No.431 dated 25.04.1981, which exempts employees above 40 years from posting in hill stations, the petitioner submitted a representation. The first respondent approved her transfer to Coimbatore Region, but the second respondent has not issued the consequential posting
order for over seven months. Hence, the petitioner seeks a direction to the respondents to issue the posting order at Coimbatore.

4. Considering the facts and circumstances of the case and the
submissions made by the learned counsel appearing for both sides, this Court, without going into the merits of the case, directs the respondents to consider the representation of the petitioner, in the light of G.O.Ms.No.431, P&AR (Per.M) Department, dated 25.04.1981. The respondents shall afford an opportunity of personal hearing to the petitioner and pass appropriate orders on merits and in accordance with law, within a period of six (6) weeks from the date of receipt of a copy of this order.
5. With the above direction, this Writ Petition stands disposed of.
