1. Learned Senior Advocate appearing for the petitioner submits that the case was registered in the year 2023. Petitioner has been arrested on or about 19th of May,
2026. It has been further contended that petitioner’s name was not appearing earlier in course of the investigation but has subsequently surfaced according to the prosecution. 2. Learned Advocate for the State has opposed the prayer for bail and produced the Case Diary. 3. I have taken into account the statements of one Ali Hossain and Ujjwal Sekh which was recorded on
04.02.2023. The said two persons again made statement on 09.04.2026. Having considered the same, I find

variation in the statement. However, the same is subject to cross-examination at the time of trial. 4. Having taken into account the period of detention, charge-sheet having been submitted before the jurisdictional Court and the factum of materials appearing I am of the opinion that further detention of the present petitioner is unwarranted. 5. Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Md. Aenyetullah shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Additional Chief Judicial Magistrate, Lalbagh. 6. If on bail, the petitioner shall be physically present on each and every date before the learned Trial Court and shall not leave the district of Murshidabad without prior permission of the learned Trial Court. 7. With the aforesaid observation, C.R.M (M) 2093 of 2026 is allowed. 8.
