A warrant of arrest was issued against the petitioner by the learned Additional Chief Judicial Magistrate, Barrackpore, North 24-Parganas, in connection with G.R. Case No. 2041 of 2025 under Sections 232(1)/351(2)/3(5)/103(1) of the Bharatiya Nyaya Sanhita, 2023 owing to the failure of the petitioner to appear before the learned Magistrate. As the warrant of arrest remained unexecuted, orders for proclamation and attachment were subsequently issued. The petitioner has challenged the said orders before this Court. Learned advocate appearing for the petitioner, however, submits that the petitioner is now willing and prepared to surrender before the learned Magistrate. 2 In view of the aforesaid submission, the warrant of arrest issued against the petitioner is stayed for a period of one month from the date of this order, subject to the condition that the petitioner shall surrender before the learned Magistrate within the said period. In the event the petitioner surrenders before the learned Magistrate, any application for bail filed by him shall be considered and decided in accordance with law, without being influenced by any observation made in this order. In the event the petitioner fails to surrender within the stipulated period in terms of this order, the warrant of arrest shall stand revived automatically, and the learned Magistrate shall be at liberty to execute the same in accordance with law. Accordingly, CRR 778 of 2026 is disposed of. Urgent Photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
