JUSTICE S VISHWAJITH SHETTY ORAL ORDER 1. Accused no.2 in C.C.No.19384/2019 pending before the Court of XCII Addl. Civil & Sessions Judge, c/c LVIII Addl. City Civil & Sessions Judge, Bengaluru, arising out of Crime No.424/2015 registered by Mahalaxmi Layout Police Station, Bengaluru, for the offences punishable under Sections 420, 406, 34 of IPC, is before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned Counsel for the parties. 3. Perusal of the material on record would go to show that petitioner is an attesting witness to the agreement for sale executed by accused no.1 in favour of the first informant who is the alleged victim in the present case. Accused no.1 who was arrested in the present case was enlarged on bail. After filing of charge sheet, since the petitioner had not appeared before the Court of learned Magistrate, a split up case was registered against him in C.C.No.19384/2019 and coercive steps were taken against him. After coming to know about the same, he had approached the jurisdictional Sessions Court in Crl. Misc. No.7277/2026, which was dismissed on 29.07.2026. 5. Learned Counsel for the petitioner, at this stage, submits that petition may be dismissed as not pressed with liberyt to the petitioner to surrender before the jurisdictional Court and file necessary application seeking regular bail. He also submits that considering the nature of allegations found against the petitioner, the concerned court may be directed to dispose of the application seeking regular bail on the same day. 6. The aforesaid submission is placed on record. Accordingly the following order: 6. In the event, petitioner surrenders before the jurisdictional Court and files necessary application seeking regular bail, such application shall be considered and disposed of on merits on the same day.
