Kartik Order The petitioner/accused has filed this Criminal Original Petition seeking to call for the records in the FIR in Crime No.231 of 2025 pending on the file of the respondent Police and to quash the same. 2.The petitioners herein are arrayed as Accused Nos. 1 to 3 in the above FIR registered based on the complaint given by the 2nd respondent /defacto complainant alleging that on 08.06.2025 at about 11 pm, near SBI ATM, Royapettah, the petitioners were restrained the 2nd respondent and abused him in https://www.mhc.tn.gov.in/judis CRL OP No. 10313 of 2026 __________ Page3 of 10 filthy language, and taken away his mobile phone. The petitioners were arrested on 13.06.2025 by the respondent police and the petitioners/ A2 and 3 were enlarged on bail on 17.06.2025 and the petitioner /A-1 was enlarged on bail on 19.06.2025 respectively. 3. It is submitted by the learned counsel for the petitioner that the complaint arose out of a sudden misunderstanding and trivial altercation between the petitioners and the defacto complainant and has now been amicably settled between the parties. The learned counsel for the petitioners and the learned counsel appearing for the 2nd respondent would submit that the dispute between the parties has been amicably settled A Joint Memo of Compromise, duly signed by the petitioner and the defacto complainant, has been filed before this Court. The parties are also present in person and have been identified by their respective counsel. 4. The learned counsel appearing for the defacto complainant would submit that in view of the settlement arrived at between the parties, the defacto complainant has no objection for quashing the FIR. This Court has considered the submissions made and perused the materials https://www.mhc.tn.gov.in/judis CRL OP No. 10313 of 2026 __________ Page8 of 10 placed on record. 6. The dispute between the parties does not involve any overriding public interest and is essentially private in nature. In view of the amicable settlement arrived at between the parties, no useful purpose would be served in keeping the criminal proceedings pending. In such circumstances, this Court is inclined to exercise its inherent powers under Section 482 Cr.P.C. to secure the ends of justice. 7. Accordingly, the FIR in Crime No.231 of 2025 pending on the file of the respondent Police Inspector of Police, D-2,Anna Salai Police Station, Chennai , is hereby quashed and this Criminal Original Petition is allowed. The consent affidavit filed by the petitioners shall form part of this order. Consequently, connected miscellaneous petitions, if any, are closed. 8.
