16.09.2026 Court No.35. M/L.252. Rakib (Rejected) CRM (NDPS) 1716 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kumarganj Police Station case no. 445 of 2025 dated 20.12.2025 under Sections 21(c)/22(c)/23(c)/25/27(A)/28/29 of the NDPS Act. And In the matter of : Majidhur Sarkar ……Petitioner. Mr. Kaushik Chowdhury Mr. Dwaipayan Panda ......for the Petitioner. Mr. Rajen Banerjee Mr. Goutam Dey ……for the State. Learned advocate appearing for the petitioner submits that the alleged recovery in the present case is 47 bottles of wincerex cough syrup and 131 bottle of eskuf cough syrup, allegedly the same was recovered from the house of the present petitioner. Learned advocate appearing for the State opposes the prayer for bail. Having regard to the quantum of seizure, I am of the opinion that rigors of Section 37 of NDPS Act is attracted. As such, at this stage, the prayer for bail of the petitioner is rejected. Petitioner will renew his prayer for bail after the seizure list witnesses are examined. Learned trial Court is directed to expedite the process. Accordingly, CRM (NDPS) 1716 of 2026 is dismissed. 2 All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
