Order No.
ORDER(ORAL) 23.04.2026
02. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode). 2. This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Padampur P.S. Case No.240 of 2025 corresponding to G.R. Case No. 851 of 2025 pending in the file of learned S.D.J.M., Padampur, for commission of offences punishable U/Ss. 316(4)/318(4)/305(e)/3(5) BNS, on the main allegation of misappropriating Government money to the tune of Rs.22,30,225/- with the active assistance of co-accused. 3. Heard, Mr. Prasanta Kumar Routray, learned counsel for the petitioner and Mr. S.C. Pradhan, learned Additional Public Prosecutor in the matter and perused the record. 4. After having considered the rival submissions upon perusal of record, there appears allegation against the petitioner for misappropriating Rs.22,30,225/- by making withdrawal of the same and depositing in his account, but the written instruction so produced today reveals that out of this amount, a sum of Rs.77,500 to the account of co-accused- Khirodra Bhoi and a sum of Rs.1,50,000/- to the account of Sushama Bhoi w/o-Khirodra Bhoi have been deposited,
however, there is no instruction with regard to disposal of rest of the amount. It is not disputed that the petitioner is in custody since 06.02.2026 and in the meantime, charge-sheet has already been filed. Further, co-accused Khirodra Bhoi has already been granted bail by this Court in BLAPL No.11678 of
2025. In the aforesaid premises and taking into consideration the nature and gravity of the offences as alleged against the petitioner and keeping in view the other circumstances on record in entirety including the inherent right of the accused to be presumed innocent until proven guilty at the trial, this Court considers it proper to grant bail to the petitioner, but subject to his furnishing cash surety of Rs.5,00,000/-(Rupees Five Lakh), if the amount allegedly withdrawn & misappropriated (Rs.2002725/-) by the petitioner has not yet been recovered/freezed. 5. Hence, the bail application of the petitioner stands allowed and the petitioner is allowed to go on bail on furnishing bail bonds of Rs.1,00,000/- (Rupees One Lakh) only with two solvent sureties each for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it. 6. Accordingly, the BLAPL stands disposed of. Issue urgent certified copy of the order as per Rules.
A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference. (G. Satapathy)
