2. The petitioners have preferred this writ petition under Article 226 of the Constitution of India, seeking following relief(s):- A. A writ and/or an order in the nature of writ of appropriate nature do issue calling the records of the case from the respondents for its kind perusal. B. A writ and/or an order in the nature of writ of certiorari do issue quashing the entire action of the respondents of issuance of notice dated 27.2.2026 and its continuance since amounts to assumption of jurisdiction not vested in it by law and also in violation of petitioners' fundamental and constitutional rights. C. A writ and/or an order in the nature of writ of appropriate nature do issue restraining the respondent authorities from taking any action in respect of order dated 23.2.2026 (Annexure P-1) / notice dated 27.2.2026 and to continue with the said action as it amounts o malice in law and malice in fact and also in violation of petitioners' constitutional and others rights. Fundamental, D. Any other relief which this Hon'ble Court may deem fit in the facts & circumstances of case. E. Cost of the petition may also be awarded.

Learned counsel appearing for the petitioners submits that petitioner No.1 is a society constituted under relevant provisions of the Chhattisgarh Society Registrikaran Adhiniyam, 1973, bearing registration No.2162 dated 26.4.1971, which runs a college in the name and style of petitioner No.2. He further submits that on account of a complaint dated 09.12.2025 (Annexure- P/4) made by respondent No.4 & 5, notice was served to the petitioners, to which they submitted detailed reply explaining that there is no irregularity or illegality in the management and functioning of the aforesaid college. Despite the said reply, Respondent No. 2, on the basis of the aforesaid
3 complaint (Annexure P/4), has ordered an enquiry vide Annexure P/1.
Learned counsel further submits that as per the complaint (Annexure-P/4), it has been alleged that one Dr. RP Pandey, who was the Professor of DP Vipra College, was not granted salary and retiral dues for the period of his suspension. It is also alleged that one Grade-III employee namely Arun Kumar Kashyap was illegally removed from service, though he was subsequently reinstated pursuant to an order of the Government, but, they approached the High Court by filing writ petition, which remained pending for 17 years, thereby causing harassment. Learned counsel further submits that
order impugned (Annexure-P/1) is vague, as it does not specify the particular issues or points on which the enquiry is to be conducted. Hence, it is prayed that impugned order dated 23.02.2026 (Annexure-P/1) deserves to be quashed.

In reply, learned counsel for the State submits that various allegations have been raised in the complaint (Annexure-P/4) against the management of the petitioner-college, particularly with regard to financial irregularities. On the basis of said complaint, the Registrar has taken suo motu cognizance of the matter and passed Order dated 23.02.2026 (Annexure-P/1), observing therein the necessity to conduct an inquiry about functioning, formation and financial condition of the Committee and the Colleges. As also to investigate the points of complaint received and information and violation of Sections 27 & 28 of the Chhattisgarh Society Registrikaran Act, 1973 presented by the Institution. Therefore, learned counsel submits that the contention raised by the petitioners that the impugned order is vague, is not sustainable. Learned counsel further submits that the Registrar has also appointed enquiry officer to conduct the enquiry. It is further submits that impugned order is appealable before the State Government, therefore, this petition is not
4 maintainable. Learned counsel lastly submits that, in the event the impugned
order is quashed, liberty may be granted to Respondent No. 2 to pass a fresh, detailed order so as to effectively serve the purpose of conducting an enquiry on specific issues. 5. Heard learned counsel for the parties and perused the material available on record. 6. The impugned order dated 23.02.2026 (Annexure-P/1), whereby enquirey has been directed to be conducted, is reproduced as under:-

Perusal of the impugned order shows that it has been passed by the Registrar/respondent No.2 on account of complaint received against petitioners 1 & 2, hence, it has been directed by the Registrar to enquire about the functioning, formation and financial condition of the Committee and the Colleges. 8. In pursuance of the impugned order (Annexure-P/1), notice (Annexure- P/2) has been served to the petitioners along with list of documents to be produced by them.

9. A bare perusal of Order dated 23.02.2026 (Annexure-P/1) and the list of documents, which has been sought to be produced by the petitioners, show that the order as well as the list of documents are completely vague and unspecific.
Neither the order identifies any particular issue concerning the management, constitution or financial status of the society, nor does it specify the relevant period, year, or nature/specific fact(s) of the alleged irregularities that are to be inquired into. Similarly, the list of documents is also completely vague as it does not mention any specific dates and period etc. In Clause 23 of the list of documents, submission of bank passbook/bank statement for the entire period has been sought. As submitted by learned counsel for the petitioners, D.P. Vipra College/petitioner No.2 has been in operation since 26.09.1971. However, neither the complaint
7 (Annexure P/4) nor the impugned order contains any allegation or material suggesting financial irregularity or mismanagement since 1971. 10. Having considered the vagueness in the order dated 23.02.2026 (Anenxure-P/1) and in the list of documents, as reproduced hereinabove, it is difficult to understand as to what fact(s), allegation(s), irregularities or illegalities have to be enquired. Therefore, instead of keeping this petition pending, this Court deems it appropriate to set aside the impugned order dated 23.02.2026 (Annexure-P/1) as well as the subsequent notice dated 27.02.2026 (Annexure-P/2) issued to the petitioners 1 & 2, while granting liberty to respondent No.2 to pass order afresh. 11. Accordingly, impugned Order dated 23.02.2026 (Annexure-P/1) and notice dated 27.02.2026 (Annexure-P/2) along with list of documents are quashed. However, liberty is left with the respondent No.2 to pass fresh, reasoned and speaking order, clearly specifying the particular point(s) of enquiry, act of irregularity, illegality, the relevant period etc. so as to enable proper understanding, response and adjudication of the issues involved. 12. In view of the above, the present petition stands disposed of to the extent indicated hereinabove. 13. Pending interlocutory application(s), if any, stands disposed of.
