Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record. 2. The instant bail application has been filed with a prayer to release the applicant on bail in Case Crime No.32 of 2026, under Sections 109(1), 351(2) and 352 of the B.N.S., Police Station- Chakiya, District- Chandauli, during the pendency of the trial. 3. Learned counsel for the applicant contends that the applicant has been falsely implicated in the present case along with his father. It is further contended that only a general role of assault has been given to the applicant. There is no injury sustained by the injured, which may be considered to be dangerous to life. Similarly situated co-accused Rana Singh, father of the applicant, has already been granted bail by this Court vide order dated 01.04.2026 passed in Bail Application No.11088 of 2026. The applicant has no criminal antecedents and is in jail since 13.02.2026. 4. Learned A.G.A. has opposed the prayer for bail and has contended that grievous injuries have been inflicted upon the injured by the applicant. He, however, does not dispute the fact that the case of the applicant is at par with the co-accused Rana Singh, who has already been granted bail by this Court. 5. I have considered the submissions made by the learned counsel for the parties. 6. A perusal of the entire material on record indicates that the injured was examined in the Department of Radio-diagnosis & Imaging Institute of Medical Sciences, B.H.U., Varanasi, and as per the X-ray report, no bony injury was seen. The CT Scan examination, however, indicates a fracture in the left orbito-frontal bone of the forehead, however, the specific head injury, which has led to the fracture, has not been assigned to the applicant. Rahul Singh .....Applicant(s) State of U.P. .....Opposite Party(s) Only a general role has been assigned to the applicant and the case of the applicant is at par with that of co-accued Rana Singh. The co-accused Rana Singh is stated to have a criminal history of twelve cases, whereas the applicant has no criminal antecedents. 7. Taking into account the entire facts and circumstances of the case as also the fact that the applicant is in jail since 13.02.2026 and is no longer required for custodial interrogation as the charge sheet has already been submitted, and without expressing any opinion on the merits of the case, I deem it appropriate to grant bail to the applicant. 8. Let the applicant - Rahul Singh, involved in the aforementioned crime be released on bail, on his furnishing a personal bond and two sureties each in the like amount, to the satisfaction of the Court concerned, subject to the following conditions: i. The applicant will not tamper with the evidence. ii. The applicant will not indulge in any criminal activity. iii. The applicant will not pressurize/intimidate the prosecution witnesses and co-operate in the trial. iv. The applicant will appear regularly on each and every date fixed by the trial Court, unless his personal appearance is exempted by the Court concerned. 9. In the event of breach of any of the aforesaid conditions, the Court below will be at liberty to proceed to cancel his/her bail. 10. It is made clear that the applicant shall be released on the basis of computer generated copy of this order, downloaded from the official website of High Court Allahabad and verified by the concerned counsel with the undertaking that the certified copy will be filed within 15 days. 11. It is further directed that the trial court shall send the release order to the concerned jail through Bail Order Management System (BOMS) to ensure early release of the applicant.
