Learned advocate appearing for the petitioner submits that the case has been registered for threatening the informant. There was an earlier case pursuant to the same the present case has been initiated to harass the petitioner. So far as the State is concerned, State has produced the Case Diary opposed the prayer for anticipatory bail and submitted that by way of Whatsapp and other social networking platforms victim has been threatened. Having regard to the materials available in the Case Diary, I am of the opinion that although case has been made out but custodial detention of the present petitioner is unwarranted. As such, prayer for anticipatory bail of the petitioner namely, Anayatulla Shaikh @ Enayetullah is allowed.
2 Accordingly, in the event of arrest, the petitioner shall be released on bail to the satisfaction of the Arresting Officer on such terms and conditions as he deems fit and proper subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is still in progress, the petitioner shall report to the Investigating Officer of the case within a period of ten days. In case, the petitioner do not report to the investigating officer within a period of ten days, this order of anticipatory bail will be deemed to be cancelled. Accordingly, CRM (A) 2823 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
