1. This is first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant in Crime No. 306/2024 registered at Police Station Arjuni District Dhamtari (C.G) (CG) for the offences under Sections 137(2), 87, 64(2)(m), 65(1) of BNS and Section 6 of the POCSO Act, 2012.

As per the prosecution case , on 26.12.2024 the complainant lodged a oral report at the police station stating that on 23.12.2024 his minor daughter, aged about 14 years and 10 months had gone to somewhere without informing anyone at home and when she did not return the home, search was made but she could not be traced. He raised suspicion that an unknown person allured and taken her away from their lawful custody without their permission. On such report the FIR was registered. During investigation, the girl was recovered on 25.05.2025 from the present applicant and he was arrested on 26.05.2025. Learned counsel for the applicant submits that from the court statement of victim, it is clear that the victim was in love with the applicant; she had voluntarily accompanied and performed marriage with him and then both they had resided together as wife and husband for a considerable period, therefore, she was consenting party. He further submits that though the prosecutrix is shown to be minor, yet the evidence of correct age has not been collected by the prosecution. He submits that the applicant is in jail since 26.05.2025 and till date out of a total 16 witnesses, only 5 have been examined and there is no immediate possibility of disposal of case, therefore, he may be enlarged on bail.
4. Per contra, learned State Counsel opposes the bail application and submits that at the time of incident, the victim was minor.
5. The victim along with her parents has appeared through VC from the concerned DLSA and raised objection to grant bail.
6. Having considered the submissions made by learned counsel for the parties; the overall facts and circumstances of the case and further looking to the age of the victim, I am not inclined to release the applicant on regular bail. Accordingly, his bail application is rejected.
7. However, looking to the custody period of the applicant, the trial Court is directed to conclude the trial as early as possible preferably within a period of 5 months.
8. Registry shall send a copy of this order to the trial Court for necessary information.
