During the course of submissions, it has transpired that in terms of Section 89 of the Motor Vehicles Act, 1988, State Transport Appellate Tribunal has already been constituted and made functional. 2 2. In the circumstances, the present writ petitions are disposed of with liberty to the petitioner to file afresh with the self-same cause of action before the State Transport Appellate Tribunal. The parties undertake that they shall invoke the jurisdiction of the State Transport Appellate Tribunal within three weeks from date. 3. The State Transport Appellate Tribunal shall consider and decide the same expeditiously in accordance with law. The State Transport Appellate Tribunal shall also consider the delay, if any, in preferring the application taking into account the pendency of the present writ petitions before this Court. 4. Accordingly, present writ petitions are disposed of. 5. However, it is made clear that this Court has not gone into the merits of the case and no expression made herein shall tantamount to be an expression on the merits of the case. 6. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court. (Dinesh Kumar Sharma, J.)
