Heard the learned advocate for the petitioner and the learned A.G.P. 3. The present writ petition arises out of an Original Application bearing O.A. No. 148 of 2026. The O.A. itself was filed when The West Bengal Administrative Tribunal (‘Tribunal’ for short) was non-functional. If the Tribunal was non- functional, the petitioner’s remedy was before the Writ Court (Single Judge Bench) dealing with the determination of service matters. 4. The learned advocate for the writ petitioner, thus, submits that he will avail the remedy in accordance with law. 2 5. In view of the above circumstances and submissions, we grant liberty to the petitioner to approach the Single Judge Bench for the self- same relief after giving an undertaking that the petitioner will withdraw the Original Application bearing O.A. No. 148 of 2026 pending before the Tribunal. 6. The Writ Petition is disposed of in the above terms. 7. The order of the Hon’ble Single Judge dated 02.09.2026 passed in the WPA 23290 of 2026 shall not stand in the way. (Madhuresh Prasad, J.) (Partha Pratim Roy, J.)
