JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused in Special Case No.1908/2026 pending before the Court of the Additional City Civil and Sessions Judge, FTSC-III, Bengaluru City arising out of Crime No.167/2026 registered by Indiranagar Police Station, Bengaluru City for the offences punishable under Section 65(1) of BNS, 2023 and Sections 4(2) and 6 of POCSO Act, - 3 - HC-KAR CNR: KAHC010562302026 NC: 2026:KHC:50371 CRL.P No. 12348 of 2026 2012, is before this Court in this petition filed under Section 483 of BNSS 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.167/2026 was registered by Indiranagar Police Station, Bengaluru City for the aforesaid offences against unknown person, based on the first information dated 20.05.2026 received from respondent No.2-Kavitha, who is the mother of the victim girl. During the course of investigation, the petitioner was arrested on 21.05.2026 and remanded to judicial custody. His bail application filed before the Trial Court in Crl.Misc.No.5130/2026 was rejected on 04.08.2026. Therefore, he is before this Court. 4. In the first information submitted by the mother of the victim girl, it is stated that the victim girl was studying in ninth standard and had complained of stomach pain and when she was medically examined, it was found that she was 20 weeks pregnant. It is under these - 4 - HC-KAR CNR: KAHC010562302026 NC: 2026:KHC:50371 CRL.P No. 12348 of 2026 circumstances FIR was registered against unknown person based on the first information received from the mother of the victim girl. It appears that subsequently the victim girl had revealed that the petitioner was the cause for her pregnancy. It is under these circumstances the petitioner was arrested and remanded to judicial custody. Investigation of the case is now completed and charge sheet is filed. The petitioner, aged 24 years, has no other criminal antecedents. He is in custody for last nearly four months. 5. Learned advocate appearing on behalf of respondent No.2 has submitted that respondent No.2 is present in person before the Court and she has no objection to allow the bail petition. She submits that the parents of both the parties have decided to perform the marriage of the petitioner and the victim girl after the victim girl attains the age of majority. - 5 - HC-KAR CNR: KAHC010562302026 NC: 2026:KHC:50371 CRL.P No. 12348 of 2026 6. Considering the aforesaid aspects of the matter and also the age of the parties, the following: O R D E R i) The Criminal Petition is allowed. ii) The petitioner is directed to be enlarged on bail in Special Case No.1908/2026 pending before the Court of Additional City Civil and Sessions Judge FTSC-III, Bengaluru City arising out of Crime No.167/2026 registered by Indiranagar Police Station, Bengaluru City for the offences punishable under Section 65(1) of BNS, 2023 and Sections 4(2) and 6 of POCSO Act, 2012, subject to the following conditions: a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial - 6 - HC-KAR CNR: KAHC010562302026 NC: 2026:KHC:50371 CRL.P No. 12348 of 2026 Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
