Das, ASC -versus- The Assistant Provident Fund Commissioner (PD) EPFO, Regional Office, BBSR ..... Opposite Party Mr. R. Chimanka, Advocate CORAM: THE HON'BLE MR. JUSTICE BIRAJA PRASANNA SATAPATHY ORDER 24.04.2026 Order No. 01 1. This matter is taken up through hybrid mode. 2. Heard learned counsel appearing for the Parties. 3. The present writ petition has been filed inter alia challenging order dtd.26.06.2025 so passed in ATA Case No. 28 of 2025 under Annexure-9. The appeal so filed by the State was rejected on the ground of the delay. 4. It is contended that since the appeal has been dismissed on the ground of delay, instead of deciding the appeal on merit, the impugned order is not sustainable in the eye of law. 5. Mr. R. Chimanka, learned counsel appearing for the Opp. Party relying on an order passed by this Court on 07.04.2026 on similar issue, contended that this Court in the said writ petition, has already held that since there is no such provision for condonation of delay in filing the appeal under the provision of EPF Act, no illegality or Page 2 of 2. irregularity can be found with the impugned order. Copy of the order dtd.07.04.2026 so produced in Court be kept in record. 6. This Court after going through order dtd.07.04.2026, also finds that similar issue as raised in the present writ petition was the subject matter in W.P.(C) No. 1057 of 2026. Placing reliance on the said order, this Court is not inclined to entertain the writ petition having found no illegality or irregularity in the impugned order. 7. Accordingly, the writ petition stands dismissed. 8. Appearance memo filed by Mr. R. Chimanka, learned counsel be kept in record. (BIRAJA PRASANNA SATAPATHY) Judge Sneha
