No.1617 of 2026 ORDER (Order of the Court was made by the Hon'ble Chief Justice) This contempt petition alleges non-compliance of the order dated 22.10.2025 passed in WP No.28090 of 2025 whereby the bank was directed to remove all the movables lying in the house in question, within a period of 15 days. 2. Learned counsel for the bank submits that they are unable to comply with the order since the borrower has permanently sealed the gate of the apartment by putting iron bars. In this regard, the bank has lodged a police complaint on 08.06.2026. He further submits that unless and until the gate is opened, the bank would not be in a position to remove the movables and hand over the property to the auction-purchaser. 3. As the respondent bank has already lodged a police complaint against the permanent sealing of the gate by the borrower, we do not find any willful disobedience on the part of the bank. https://www.mhc.tn.gov.in/judis Cont.P.
