The Criminal Petition has been filed under Section 439(1)(b) of the Code of Criminal Procedure, 1973 (for brevity „the Cr.P.C.,‟)/Section 483(1)(b) of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity „the BNSS‟), seeking to modify the condition imposed on the petitioner/owner of the vehicle vide order dated 05.02.2026 in Crl.M.P.No.28 of 2026 in Crime No.49 of 2025 of Madugula Police Station, passed by the learned I Additional District and Sessions Judge-Special Judge for Trial of Offences under NDPS Act, Visakhapatnam
2. The learned counsel for the petitioner submits that the financial condition of the petitioner is deplorable and he is unable to comply with the conditions imposed by the learned Trial Court. 3. Heard learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 4.
Considering the above facts and circumstances of the case, the order dated 05.02.2026 in Crl.M.P.No.28 of 2026 in Crime No.49 of 2025 of
Madugula Police Station, passed by the learned I Additional District and Sessions Judge-Special Judge for Trial of Offences under NDPS Act, Visakhapatnam, against the petitioner/owner of the vehicle, is hereby modified as under: i. The Petitioner/owner of the vehicle shall execute a bond for Rs.9,00,000/- (Rupees Nine lakh Only) with one surety for like sum to the satisfaction of learned Judicial Magistrate of First Class, Paderu. The petitioner shall furnish Bank Guarantee for Rs.5,00,000/- (Rupees Five lakh only). 5. The residual conditions imposed by the learned Trial Court, in the original order shall remain in force and shall be duly complied with by the Petitioner/owner of the vehicle. 6.
