Anwar Hossain Ms. Benajir Hasna Mr. Aliul Islam …for the petitioners Mr. Ranojoy Chatterjee Mr. Ayon Shubhra Bandopadhyay ..for the State Learned counsel appearing on behalf of the petitioners submits that the petitioners had previous dispute as such have been implicated in the present case. Learned advocate for the State opposes the prayer for anticipatory bail. I have taken into account the statement of one of the injured under Section 183 of the BNSS. There are specific accusations against the petitioner no.1 (Tuel Sk @ Moin Sekh), petitioner no.4 (Akash Sk @ Ahammed Sk) and petitioner no.8 (Chandan Sk @ Rohan Sk). So far as the other accused persons are concerned, the injured did not name them although there are reference to other persons who have been involved. Since there are specific accusations against 2 the petitioner nos.1, 4 and 8, their prayer for anticipatory bail is rejected. The petitioner nos.2, 3, 5, 6, 7 and 9 are concerned, their prayer for anticipatory bail is allowed. Accordingly, in the event of arrest, the petitioners viz., Pintal Sk. @ Abdul Karim Sk, Mustak Sk @ Mostak Sekh, Maruk Khan @ Marup Kha, Imran Sk, Rahit Sk. @ Jagir Hossain and Alaudduddin Sk. @ Alauddin Sk shall be released on bail to the satisfaction of the Arresting Officer on such terms and conditions as he deems fit and proper and also be subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is still in progress, the petitioners viz., Pintal Sk. @ Abdul Karim Sk, Mustak Sk @ Mostak Sekh, Maruk Khan @ Marup Kha, Imran Sk, Rahit Sk. @ Jagir Hossain and Alaudduddin Sk. @ Alauddin Sk shall report to the Investigating Officer of the case within a period of ten days from date and thereafter on all subsequent dates fixed by the Investigating Officer, if required for the sake of investigation, till the report in final form is submitted before the jurisdictional Court. Memo of evidence submitted by the learned advocate appearing for the State be kept with the record. The application for anticipatory bail, being CRM (A) 2657 of 2026, is, thus, disposed of.
