Case No.412 of 2025 dated 21.12.2025 under Section 316(2) of the BNS, 2023. And In the matter of: Rita Tandon … petitioner Mr. Rachit Lakhmani Mr. Mrigank Kejriwal … for the petitioner Mr. Arindam Sen Mr. Aniket Mitra … for the State Learned counsel for the petitioner submits that it is alleged that the petitioner took delivery of goods of Rs.3 lakhs and did not pay for the same. It has been suppressed from the FIR that between 2015 to 2022, there were transactions to the tune of Rs.99 lakhs. Out of such dues, Rs.96 lakhs was paid. The petitioner made it clear in his last communication made in January, 2023 that he was not going to pay Rs. 3 lakhs as the goods were sub standard. By suppressing all these, the present FIR has been lodged. Learned counsel for the State opposes the prayer for anticipatory bail and relies on the statements of witnesses and copies of documents collected. However, he submits that the petitioner has complied with the notice issued. Considering the above and the other materials available in the case diary, I do not think that custodial interrogation 2 of the petitioner is required in this case and I am inclined to grant anticipatory bail to the petitioner. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- (rupees ten thousand) with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on the further conditions that the petitioner shall cooperate with the investigation and shall not threaten or intimidate witnesses. The application for anticipatory bail is, thus, allowed. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
