Accused No.4 is before this Court in this petition filed under Section 482 of BNSS, 2023 seeking transit interim bail in Crime No.345 of 2019 registered by Kotwali Police Station, Gaziyabad, Uttar Pradesh State. 2. Learned counsel for the petitioner submits that the petitioner was not aware of the pendency of the aforesaid case and only after the enquiry notice was received by him recently, he came to know about the same. He submits that, to enable the petitioner to approach the jurisdictional Court and file necessary application seeking anticipatory bail in Crime No.345/2019 some protection is necessary for him since he - 3 - HC-KAR CNR: KAHC010631522026 NC: 2026:KHC:51252 CRL.P No. 14122 of 2026 apprehends arrest at the hands of Kotwali Police Station on his way to Gaziyabad. 3. Per contra, learned HCGP has opposed the petition. 4. A reading of the notice received by the petitioner which is issued by the investigation officer in the aforesaid case would reveal that the petitioner was already granted bail in the present case earlier and subsequently the said bail was cancelled by the Hon'ble Court. It is also mentioned in the said notice that the petitioner has not cooperated for the purpose of investigation and in spite of repeated notices he has not appeared before the investigation officer. Under the circumstances, I am of the opinion that the prayer made by the petitioner for grant of interim transit anticipatory bail cannot be entertained. 5.
