1. The instant application has been filed under Sections 483 and 484 of BNSS, 2023 for grant of bail in connection with Protest-cum- complaint Case No. 1947 of 2021 registered under Sections 328, 302 and 34 of the IPC pending in the court of JMFC, Hazaribagh. 2. It has been contended by the learned counsel appearing on behalf of the petitioner that it is a case where the FIR was instituted by the informant but in course of the investigation, no accusation has been found to be there, as such, the final form was submitted. 3. The informant on being noticed has filed protest which has been considered by the learned Magistrate and based upon that prima facie offence has been found against the three accused persons,

namely, Parmeshwar Yadav @ Prameshwar Yadav, Mahesh Yadav and the present petitioner. 4. It has further been submitted that the co-accused persons, namely Parmeshwar Yadav @ Prameshwar Yadav and Mahesh Yadav have been directed to be released on bail by the orders passed on 19.08.2025 and 02.12.2025 by the Co-ordinate Bench of this Court in B.A. No. 2800 of 2025 and B.A. No. 9859 of 2025, respectively. 5. Submission has also been made that the case of the present petitioner is also identical to the case of the aforementioned persons. 6. Further, it has been submitted that the implication of the present petitioner along with other accused persons are there merely on the basis of suspicion and the case diary has been called for by this Court vide order dated 20.02.2026. 7. As such, the present petitioner may also be enlarged on bail. 8.
Learned Additional Public Prosecutor appearing for the opposite party-State although has vehemently opposed the prayer for grant of bail but he is fair enough to admit the fact that the co-accused persons named above has been directed to be released on bail and the facts and circumstances of the present petitioner are identical to them. 9. This Court considering the fact and circumstances of the case and also the fact that the petitioner is languishing in judicial custody since 12.02.2025 and two other identically placed persons has been directed to be released on bail, is of the view that the present application deserves to be allowed. 11. Accordingly, the instant bail application stands allowed. 12. In consequence thereof, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the JMFC, Hazaribagh in connection with Protest- cum-complaint Case No. 1947 of 2021 with the condition that the petitioner shall co-operate in the trial and shall not absent himself on the date fixed without any cogent cause. In failure, the learned trial court is at liberty to take appropriate steps in accordance with law so that the trial be not hindered. (Sujit Narayan Prasad, J.)
