Banerjee … for the defacto-complainant Learned advocate for the petitioner submits that the petitioner is in custody for one year two months and similarly placed other accused person has been granted bail. Learned advocate, as such, prays that the petitioner may be granted bail. State opposes the prayer for bail and submits Memo of Evidence. Learned advocate for the defacto-complainant opposes the prayer for bail and refers to the General Diary Entry. However, the G.D.Entry is of dated 30.10.2025. Presumably, at the relevant point of time, the accused was 2 in custody and the contents of the information are debatable. Having regard to the fact that similarly placed accused person has been granted bail in CRM (2424 of 2025), I am of the view that the petitioner be also released on bail on the same terms and conditions as was imposed upon Uttam Maity in CRM (M) 2424 of 2025. Hence, the prayer for bail of the petitioner [Sukumar Maity] is Allowed. Accordingly, CRM (M) 1878 of 2026 is allowed. Pending application(s), if any, is also disposed of. Memo of evidence and the General Diary Entry submitted be kept with the record.
