2. Mr. J.S. Virk, learned DAG with Mr. Rakesh Kumar Joshi, learned Brief Holder, for the State of Uttarakhand.
3. In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 and under Section 439 of the Code of Criminal Procedure (Old Code), seeking regular bail for the Applicant - Amit Kumar Raut S/o Shri Rameshwar Raut, who has been accused in Case Crime No.256 of 2017, dated 11.09.2017, under Sections 420, 342, 370 and 120-B of IPC, at Police Station Doiwala, District Dehradun. The Applicant is in judicial custody since
16.09.2025.
4. At the outset, learned counsel for the Applicant submits that the co-accused in BA 2nd No.295 of 2024 has been granted bail by the coordinate Bench of this Court vide judgment and order dated 07.10.2025.
5. Considering the overall facts and circumstances of the case and the fact that the co-accused has been granted bail by this Court, the Applicant has made out a case for bail.
6. Accordingly, bail application is allowed. It is directed that the Applicant – Amit Kumar Raut S/o Shri Rameshwar Raut, who has been accused in Case Crime No.256 of 2017, dated 11.09.2017, under Sections 420, 342, 370 and 120-B of IPC, at Police Station Doiwala, District Dehradun, be released on bail on furnishing a personal bond with two sureties each
in the like amount to the satisfaction of the concerned court. The Applicant shall cooperate with the trial proceedings and shall not misuse the liberty granted to him.
