Mr. Mit Guha Roy, Mr. Sayan Sarkar …for the petitioner In this application, the petitioner has prayed for a direction upon the Executing Court for expeditious disposal of the proceeding being M. Execution No.259 of 2025. Being aggrieved by the inordinate delay caused in disposal of the said proceeding, learned Counsel for the petitioner submits that the petitioner obtained an order to pay interim monetary relief to the tune of Rs.50,000/- per month for herself from the opposite party/husband on and from 20.12.2024. Since the opposite party/husband did not pay the said amount, the petitioner filed the aforesaid execution case on 28th April, 2025. The said execution case has not yet been disposed of and as such he prayed for necessary direction upon the Court below for expeditious disposal of the said execution case. Having heard learned Counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite party will have no cause to prejudice and as such service of copy of application upon the opposite party is dispensed with. 2 Having considered the submissions made on behalf of the petitioner and that the execution case is pending for about 1 year, I find that the prayer made by the petitioner is justified and is required to be allowed to secure the ends of justice. In view of above, CRR 3826 of 2026 is hereby disposed of with a direction upon the Court below or Court in charge of the Court below to make every endeavour for expeditious disposal of the said proceeding and to make his best effort to conclude the entire proceeding preferably within a period of 3 months from the next date of hearing.
