APP Mr. Sanjib Das … for the State-respondent(s) Pursuant to the earlier direction, the Investigating Officer of the case is present in court today with an explanation. The explanation reflects antecedent. Learned advocate for the petitioner submits that the petitioner surrendered before the learned jurisdictional court immediately after his anticipatory bail was rejected. So far as the merits of the case is concerned, the petitioner is better placed than the other accused persons namely, Sainul Khan and Asadul Malithya who have been granted bail in CRM (NDPS) 449 of 2026 and CRM (NDPS) 456 of 2026. 2 Learned advocate for the petitioner emphasizes that neither there was any recovery in the present case nor in the case as has been referred to, being Murutia PS Case No. 44 of 2025 dated 18.02.2025. Having regard to the fact that there was no recovery from the present petitioner, I am inclined to release the petitioner on bail immediately after the stage of consideration of charges is over. The learned trial court would accept the bond of the present petitioner for his release after the aforesaid stage is over. So far as the terms and conditions are concerned, the learned Special Court would impose the same terms and conditions as has been referred to in CRM (NDPS) 449 of 2026. Let the stage of consideration of charges be completed within a week from the next date fixed before the learned Special Court. Hence, the prayer for bail of the petitioner [Janarul Islam Khan] is Allowed. Accordingly, CRM (NDPS) 1886 of 2026 is allowed. Pending application(s), if any, is also disposed of. The I.O. of the case is present. His further appearance before this court for the day is dispensed with.
