JUSTICE V SRISHANANDA ORAL ORDER Learned counsel for the respondent files a memo which reads as under: “The undersigned counsel for the Respondent submits that pursuant to investigation conducted by the Respondent-agency, a prosecution complaint was filed before the Ld. Trial Court, which remained pending consideration. Shortly thereafter, the Ld. Trial Court pronounced judgment in the predicate offence, acquitting the Petitioner/accused along with the co-accused. Upon hearing arguments on the maintainability of the prosecution complaint, the Ld. Trial Court vide order dated 23.04.2025, closed further proceedings, placing reliance on the judgment in Vijay Madanlal Chaudhary, while reserving to Respondent the liberty to revive the complaint in the event the predicate - 3 - HC-KAR CNR: KAHC010471972026 NC: 2026:KHC:49351 WP No. 21462 of 2026 offence is restored by favourable orders of the higher courts. It is respectfully prayed that this Hon'ble Court may grant liberty to Respondent to revive all its proceedings, in the event the predicate offence is restored. It is prayed accordingly.” 2.
