The State of West Bengal Mr. Angshuman Chakraborty Mr. Shashanka Shekar Saha ... for the appellant Mr. Krishnendu Bhattacharya, APP Ms. Priti Kar Bagchi ... for the State By reason of a typographical error in the cause title of the order dated 3rd September, 2026, the name of Mr. Krishnendu Bhattacharyya, learned Additional Public Prosecutor, who appeared on behalf of the State, was not incorporated. Office is directed to effect necessary correction. By an earlier order dated 3rd September, 2026, the department was asked to file a report. Pursuant to such direction, a report has been filed wherein it has inter alia been stated that the case record has already been received back from the Hon’ble High Court and it is lying with the learned Trial Court. Mr. Chakraborty, learned advocate appearing for the appellant apprises this Court that the certified copy of the 2 judgment impugned has already been obtained. Let the same, as placed, be kept on record. In re: CRAN 1 of 2026 Upon hearing the learned advocate appearing for the respective parties and considering the averments made in the application for condonation of delay, we are satisfied with the explanation given towards the delay in preferring the appeal. Accordingly, such delay is condoned and the application being CRAN 1 of 2026 is disposed of. In re: CRA(DB) 297 of 2026 The appeal is admitted. Call for the records. Issue usual notices. Realization of fine, if any, be stayed. Paper books be prepared within a period of 4 weeks from the date of receipt of the Trial Court Records. Liberty is granted to the appellant to apply for bail upon notice to the State, through the learned Public Prosecutor, High Court at Calcutta.
