14th September, 2026 (AK) 10-11 F.A.T 570 of 2025 IA No: CAN 1 of 2026 With F.A.T 202 of 2026 IA No: CAN 1 of 2026 Raju Kabra and another Vs. Chowdhury Md. Soukat and another Mr. Tanmoy Mukherjee Mr. Tapan Kr. Mahapatra ….For the appellants. 1. From the Stamp Reporter’s report, we find that the appeals have been preferred against a preliminary and a final decree, both passed in a suit valued at Rs.1,45,100/-. 2. As such, the pecuniary jurisdiction to take up such appeals lies with the concerned District Judge and not this court. 3. Accordingly, FAT 570 of 2025 and FAT 202 of 2026 are dismissed as not maintainable due to lack of pecuniary jurisdiction. 4. Consequentially, the pending applications, both bearing CAN 1 of 2026, stand dismissed as well. 5. There will be no order as to costs. 6. It is made clear that nothing in the present dismissal shall preclude the appellants from 2 preferring appeals before the proper court having pecuniary jurisdiction against the self-same judgments and decrees. 7. Leave is granted to the learned Advocate-on-record for the appellants in both the appeals to take back the certified copies of the judgments and decrees impugned therein, upon furnishing photocopies thereof for the records.
