Supplementary affidavit filed by the petitioner and affidavit in support of medical issues of the opposite party nos. 3 and 9 filed by the opposite parties are taken on record. Heard learned counsels for the parties. The petitioner seeks transfer of Sessions Case no. 225 of 2024 pending before the learned Additional District and Sessions Judge, 8th Court, North 24 Parganas at Barasat to any Additional District Sessions Judge at Howrah on several counts. The petitioner is a resident of Howrah and is suffering from various ailments. She is not in a position to appear before the Barasat Court regularly. The private opposite parties are residents of Barasat and are continuously threatening the petitioner with dire consequences for which several complaints have been lodged by her against them. Also, the petitioner’s husband has lodged a criminal complaint against the private opposite parties which is pending before the Howrah Court. The private opposite parties are appearing before the said learned Court regularly. Opposing the prayer, learned counsel for the private opposite parties submits that the parental home of the petitioner is at Madhyamgram and she is a frequent visitor to Barasat. No threat has been meted out to her by the private opposite parties. Also, the
2 3rd and 9th opposite parties are suffering from various ailments and it shall be difficult for them to appear before Howrah Court on every date of hearing. I have considered the rival contention of the parties. It is not in dispute that the private opposite parties are residents of Barasat and several complaints have been lodged by the petitioner against them due to threats meted out by them against the petitioner. In view of the same, this Court is inclined to hold that possibility of their influence in the Court and creating an atmosphere of threat and fear for the petitioner cannot be ruled out. There is no recent medical document of the 3rd and 9th opposite parties in support of their illness. On the contrary, the medical documents filed by the petitioner speak about her illness.
It is also not in dispute that the opposite parties have been appearing before the learned Court in Howrah in the criminal case pending against them. In view of the above, Sessions Case no. 225 of 2024 pending before the learned Additional District and Sessions Judge, Barasat be transferred to Howrah in the interest of justice. The revisional application is allowed. Sessions Case no. 225 of 2024 pending before the learned Additional District and Sessions Judge, 8th Court, North 24 Parganas at Barasat be transferred to the Court of the learned District and Sessions Judge, Howrah for disposal. The learned District and Sessions Judge shall either deal with the case himself or assign the same to any learned Additional District and Sessions Judge within his jurisdiction. Learned Additional District and Sessions Judge, 8th Court, North 24 Parganas at Barasat is directed to transmit the case
3 records alongwith relevant documents to the Court of the learned District and Sessions Judge, Howrah within 10 days from the date of communication of this order. CRAN 1 of 2026 and CRAN 4 of 2026 are disposed of. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh, J.)
