28 1144..0099..22002266 Ct. No. 05 adeb WPA 23025 of 2026 Bristi Foujdar Vs. The State of West Bengal & Ors. Mr. Ranajit Roy Mr. Indra Prosad Mullick …for the petitioner Mr. Atanu Basu Ms. Koushikee Banerjee …for the State 1. Affidavit of service filed on behalf of petitioner is taken on record. 2. By presenting this writ petition, inter alia, petitioner has prayed for execution of warrant of arrest which was issued vide order dated 28th April, 2025 by the learned Judicial Magistrate, 2nd Court Raghunathpur (Purulia). It is further submitted that such execution of warrant of arrest is necessary for the purpose of implementation of order passed by jurisdictional authority under the Protection of Women from Domestic Violence Act, 2005 (hereinafter referred to as ‘said Act of 2005’). 3. State respondents are represented by learned advocate. 2 4. If petitioner finds that order passed by jurisdictional authority under said Act of 2005 is being frustrated due to failure to execute warrant of arrest in that event petitioner needs to approach within the four corners of statute. Writ Court while exercising jurisdiction under Article 226 of Constitution is not an appropriate forum for execution of warrant of arrest issued by Court below. 5. Hence, present writ petition is disposed of thereby granting liberty to the petitioner to approach appropriate forum in pursuit of remedy. 6. Parties to act on the server copy of this order duly downloaded from the official website of this Court. (Saugata Bhattacharyya, J.)
