Accused in S.C.No.5032/2025 pending before the Court of the II Additional District and Sessions Judge, Bengaluru South District (sitting at Kanakapura) arising out of Crime No.27/2025 registered by Kodihalli Police Station, Ramanagara for the offence punishable under Section 103(1) of BNS 2023, is before this Court in this petition filed under Section 483 of BNSS 2023 seeking regular bail. 2. 3. FIR in Crime No.27/2025 was registered by Kodihalli Police Station, Ramanagara for the aforesaid offence against the petitioner herein, based on the first information dated 27.02.2025 received from Raju (CW-1), who is the father of the deceased Nagachudaiah. In the said case, the petitioner was arrested on 28.02.2025 and remanded to judicial custody. After completing investigation, charge sheet is filed against the accused for the aforesaid offence. His bail application filed before the trial Court in Crl.Misc.No.5107/2026 was rejected on
01.07.2026. Therefore, he is before this Court. 4. First informant in the present case is the father of the petitioner and the deceased Nagachudaiah. Material on record would go to reveal that the petitioner was a vagabond and was staying in the house of CW-1 without doing any work. The deceased Nagachudaiah was earning and his income was the source of livelihood for the family. CW-1 used to advise the petitioner to go for work. - 4 -

5. On 26.02.2025, CW-1, CW-5, CW-7 and CW-8 had gone to a temple, leaving behind the petitioner and his brother Nagachudaiah in their house. It appears that Nagachudaiah had asked the petitioner who was in the house to prepare food and Nagachudaiah also abused the petitioner for the reason that he was not doing any work. The petitioner, who therefore got enraged, allegedly assaulted his brother Nagachudaiah with a big stone at about 1:30 p.m., and committed his murder. 6. The entire case of the prosecution is based on circumstantial evidence. According to the prosecution, the petitioner had confessed about the murder to CW-5 and CW-9, who are his relatives. CW-1 is the father of the deceased as well as the petitioner herein.
CW-1, who is now examined before the trial Court as PW-1, is said to have turned hostile to the case of the prosecution. The petitioner, who has no other criminal antecedents, is in custody for the last more than one year and six months. - 5 -

7. Considering the aforesaid aspects of the matter, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively, subject to appropriate conditions. Accordingly, the following:
O R D E R
i) The Criminal Petition is allowed. ii) The petitioner is directed to be enlarged on bail in S.C.No.5032/2025 pending before the Court of II Additional District and Sessions Judge, Bengaluru South District (sitting at Kanakapura) arising out of Crime No.27/2025 registered by Kodihalli Police Station, Ramanagara for the offences punishable under Section 103(1) of BNS 2023, subject to the following conditions:
a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;

b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) The petitioner shall not involve in similar offences in future;
e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off. Sd/- (S VISHWAJITH SHETTY) JUDGE
