The petitioner in the instant case is lawful operator in the restricted field by holding permits bearing no. PStp. No. 835/2003 and PStp. No. 1319/2013 for plying his vehicles from Karimpur to Yugpur and another from PLassey to Baraanduliya in respect an approved time table. 3. The petitioner raised objection with the authorities on 19.09.2025 and 29.10.2025 respectively against the illegal plying vehicle of the respondent no.5 in between the middle of the route leaving the terminal point from both end violating the conditions of the permit. 2 4. The hearing was held on two consecutive occasions namely, 15.10.2025 and 18.11.2025 by the authority concerned but till date the decision is awaiting and has not been communicated to the petitioners. 5. Non-communication of such decision is the subject matter of challenge in the instant writ petition. 6. The State respondent does not object to the same. 7. The private respondent submits that there are other operators who still plying in the same routes as per the approved rotational time table. 8. After careful consideration of the case, I am of the considered view that hearing was already concluded on 18.11.2025 in presence of all the interested persons but till date the decision has not been communicated to the petitioner and other interested persons. 9. I direct the respondent no. 2 to revisit the issue by considering the objection raised by the petitioner in respect of vehicles plying in contravention to the conditions of the permit and the approved time table. 10. The respondent no. 2 shall consider the issue by serving notices of hearing mentioning the date and time to the petitioners and other 3 interested persons who are still plying the vehicle in the said route and shall accordingly pass a reasoned order within a period of 8 weeks in accordance with law upon affording of opportunity of hearing to the petitioners and the other interested persons and communicate the same within a week thereafter. 11. The writ petitioner being WPA 395 of 2026 is disposed of without taking an exception to the merits of the case. 12. Since no affidavits have been filed all the allegations made in the writ petitions are all denied. (Smita Das De, J.)
