JUSTICE SACHIN SHANKAR MAGADUM ORAL ORDER The captioned writ petition is filed seeking for the following reliefs; (a) Issue a writ of mandamus directing the Respondents to consider the representation produced at Annexures-H and J dated 02.03.2026 - 3 - HC-KAR NC: 2026:KHC:21942 WP No. 10970 of 2026 and 23.03.2026 submitted by the petitioner in accordance with law. (b) Issue a writ of mandamus directing the Respondents to remove the name of the petitioner from the Blacklist/Blocklist maintained by the Bureau of Immigration; (c) Direct the Respondents to permit the petitioner to apply for and obtain a fresh visa to enter India; (d) Direct the Respondents to permit entry of the Petitioner into India along with necessary permission concerning her minor daughter on humanitarian grounds; (e) Pass any other order or direction deemed fit in the interest of justice and equity." 2. The petitioner, stated to be a citizen of Libreville, Republic of Gabon, calls in question the action of the respondent–authorities in having placed her on the blacklist, allegedly on the ground of repeated violations of visa conditions. Aggrieved by the said action, the petitioner has submitted detailed representations as per Annexures–H and J dated 02.03.2026 and 23.03.2026 - 4 - HC-KAR NC: 2026:KHC:21942 WP No. 10970 of 2026 respectively, seeking reconsideration of the decision to blacklist her and requesting for appropriate reliefs. It is the specific grievance of the petitioner that despite submission of the aforesaid representations, the same have not been considered by the competent authorities, thereby constraining the petitioner to invoke the extraordinary jurisdiction of this Court. 3. Learned counsel appearing for the petitioner, reiterating the grounds urged in the writ petition, would vehemently contend that the representations submitted by the petitioner require to be considered in a humanitarian perspective. It is submitted that the petitioner’s minor daughter is presently residing in India and, in that view of the matter, a liberal and pragmatic approach ought to be adopted by the respondent–authorities. Emphasis is laid on the fact that denial of entry would result in grave hardship, as the petitioner is unable to reunite with her child. Therefore, it is contended that the authorities be directed to reconsider the petitioner’s case sympathetically - 5 - HC-KAR NC: 2026:KHC:21942 WP No. 10970 of 2026 and permit her re-entry into India, at least on a tourist visa, so as to enable her to take custody of her daughter. 4. Per-contra, learned Deputy Solicitor General of India, appearing for the respondents, on instructions, would stoutly oppose the petition and submit that the petitioner is a habitual and chronic violator of visa conditions, having committed such violations on no less than five occasions. It is contended that it is only in view of such repeated infractions that the competent authorities were constrained to take the extreme step of blacklisting the petitioner. However, it is fairly submitted that in light of the subsequent representations submitted by the petitioner, particularly bringing to the notice of the authorities the fact that her daughter continues to reside in India, the said representations would be duly examined and appropriate orders would be passed by the competent authority in accordance with law. - 6 - HC-KAR NC: 2026:KHC:21942 WP No. 10970 of 2026 5. Recording the submission made by the learned Deputy Solicitor General of India and having regard to the limited grievance now canvassed by the petitioner, this Court is of the considered view that ends of justice would be met if a direction is issued to the respondent– authorities to consider the representations submitted by the petitioner in accordance with law and pass appropriate orders within a stipulated time frame. ORDER (i) The writ petition stands disposed of. (ii) The respondent–authorities are hereby directed to consider and pass appropriate orders on the representations submitted by the petitioner as per Annexures–H and J dated 02.03.2026 and 23.03.2026, in accordance with law.
