Learned advocate appearing for the petitioner submits petitioner is innocent and has been falsely implicated in connection with the instant case on the basis of statement of co-accused.
Learned advocate for the State submits that there are Call Detail Records associated with one of the accused namely, Mijanur Sarkar and the motorcycle which has been intercepted in the present case belongs to the present petitioner namely, Biplab Mondal.
2 Considering the two issues involved and the recovery of 310 Gms. of Brown Sugar in the present case, I am of the opinion, this is not a fit case for granting anticipatory bail.
As such, prayer for anticipatory bail of the petitioner, namely, Biplab Mondal in CRM (A) 956 of 2026 is dismissed.
Memo of Evidence submitted by the State be kept with the record.
