R/CR.RA/813/2016 ORDER DATED: 30/09/2026 (GJHC240539142016) IN THE HIGH COURT OF GUJARAT AT AHMEDABAD R/CRIMINAL REVISION APPLICATION (FOR MAINTENANCE) NO. 813 of 2016 ========================================================== NIMIT ASHWINBHAI THACKER Versus STATE OF GUJARAT & ANR. ========================================================== Appearance: MR RAJAN D SHAH(3101) for the Applicant(s) No. 1 MR RF BHAGAT(1350) for the Respondent(s) No. 2 MS. C.M. SHAH, APP for the Respondent(s) No. 1 ========================================================== CORAM:HONOURABLE MS. JUSTICE S.V. PINTO Date : 30/09/2026 ORAL ORDER 1. When the matter is called out, learned advocate Mr. Rajan D. Shah for the applicant as well as learned advocate Mr. R.F. Bhagat for the respondent No.2 are not present. 2. Pursuant to an order dated 16.09.2026, as the learned advocates for the respective parties were not preset, an order to issue a notice to the applicant was passed and on perusal of the record, it appears that the notice has returned unserved with the endorsement that the applicant has left the address as mentioned in the application for the past two years and his whereabouts are not known. The statement of the neighbor – Pankajkumar Pandit, has been recorded by the R/CR.RA/813/2016 ORDER DATED: 30/09/2026 (GJHC240539142016) Unarmed Head Constable, Ellis-Bridge Police Station, Ahmedabad City, wherein it is stated that the applicant had sold the house about two years ago and that his whereabouts are not known. 3. It appears that learned advocates for the respective parties have consistently remained absent before the Court to make any submissions and in view of the fact that the whereabouts of the applicant are not known, the present application stands dismissed for non-prosecution. However, it is clarified that it would be open for the applicant to revive the same in case of necessity. 4. Hence, the present application stands dismissed for non-prosecution with the above liberty. (S. V. PINTO,J) ROHAN SONI Original copy of this order has been signed by the Hon'ble Judge.
